Court dismisses legal challenge to £44m stadium development

The High Court has dismissed a contest brought by Vue Cinemas over the £44m York stadium development.

York Community Stadium consists of an arena as well as leisure and mixed-use facilities. These included plans for a 13-screen cinema.

The site, beleaguered by funding issues and the departure of its main contractor last year, was faced with fresh opposition in October 2016 when Vue launched a legal challenge to the development.

The cinema chain launched the challenge after a planning amendment was granted in June 2016 allowing developers to increase the size and design of the cinema to 13 screens.

The Vue has a 12-screen cinema at Clifton Moor.

A spokeswoman for City of York Council, said: “We welcome today’s court decision, which dismissed the judicial review. The judge found the decision making process of the planning authority to be correct.

“We remain firmly committed to the delivery of this project.

” We are reviewing the plan for the next stage with the GLL consortium and an update will be made to councillors in due course.

“This is a great step forward, but we will need to assess its impact on the timescales for the delivery of the project. This will be reviewed and the detail of the judgement considered before any further announcements are made.”

The stadium is due to become home to York City FC and York City Knights Rugby League Club  as well as providing leisure space.
