Burberry files case against retailer B+M
Fashion brand Burberry has filed a case in court against North West retailer B+M Retail Limited as an “Intellectual Property Part 7 Claim” regarding “passing off and trade marks.”
Law firm Taylor Wessing are acting for the fashion giant. They said: “we won’t be able to comment on this, but appreciate your outreach.”
A spokesman for B+M said: “B&M has no comment on this story.”
Burberry did not respond to an invitation to comment.
Burberry is known in the fashion industry for maintaining “a robust trademark monitoring strategy” and has taken action in the past to safeguard its brand against unauthorized use and counterfeit products.
In 2018 when Burberry sued Target for alleged trademark infringement. Burberry claimed that Target was selling products featuring a check pattern that resembled Burberry’s iconic trademarked check design. Burberry argued that Target’s use of a similar check pattern on scarves and other items was likely to confuse consumers and dilute the value of Burberry’s brand.
According to the Court Service, Part 7 proceedings are a process for bringing civil court claims in England and Wales, as set out in the Civil Procedure Rules (CPR). Part 7 proceedings are typically used for standard claims, such as contract disputes, personal injury claims, property disputes, and debt recovery cases.
