Manchester property developer Urban Splash has been ordered to pay \u00a346.5m to the Government in relation to remediation works carried out at seven buildings in Manchester.<\/span><\/p>\n

The Government paid more than \u00a360m for cladding at the sites, which came from the Building Safety Fund, set up in June 2020, to meet such costs following the Grenfell Tower tragedy in 2017 when 72 people died in a blaze at the London flats.<\/span><\/p>\n

The Government argued the work should have been Urban Splash\u2019s responsibility and a<\/span> six-week Tribunal began at Manchester Civil Justice Centre earlier this year, with a panel overseen by Judge Jonathan Holbrook, to consider whether the developer was liable.<\/span><\/p>\n

It focused on the seven sites, developed two decades ago, at: <\/span>Burton Place, Castlefield; Chips Building, 1 New Islington; Christabel House, Dalton Street; Emmeline House, Dalton Street; Moho Building, Ellesmere Street; Sylvia House, Dalton Street;\u00a0 and The Box Works, 4 Worsley Street.<\/span><\/p>\n

Government inspectors found they had defects relating to halting the spread of a fire at the properties.<\/span><\/p>\n

Urban Splash said it was unable to undertake the work due to financial reasons and it also claimed it could have carried out the work done by the Government cheaper.<\/span><\/p>\n

The Tribunal announced its decision today (November 5), spanning five organisations linked to Urban Splash.<\/span><\/p>\n

In response to the decision an Urban Splash spokesperson said: <\/span>\u201c<\/span>While we are reviewing it and taking legal advice our focus is finding a constructive way forward with Government while continuing to deliver much needed homes and regeneration across the country.\u00a0<\/span><\/p>\n

\u201cMaking buildings safe and protecting residents and leaseholders is of fundamental importance to Urban Splash. We have remained closely engaged throughout the remediation process, and we are pleased that the Tribunal recognised the \u2018useful and responsible assistance\u2019 Urban Splash provided with the post-Grenfell investigations into these buildings.<\/span><\/p>\n

\u201cWe are, however, disappointed by the decision to include a number of entities which played no part in the original development of these seven buildings.<\/span><\/p>\n

\u201cThis illustrates the extraordinary and far-reaching consequences of, \u2018no-fault\u2019 Building Safety Act which allows liability to extend beyond the original developer to associated companies which played no part in the original development of the buildings concerned.\u201d<\/span><\/p>\n

They added: \u201cThe seven buildings concerned were developed approximately 20 years ago, received all relevant consents and have won numerous awards.<\/span><\/p>\n

“The scale of the liability identified by the tribunal is significant for a business of our size.<\/span><\/p>\n

\u201cThroughout these proceedings, we have continued to work closely and constructively with government. We are particularly reassured that government and its agencies have continued to support and fund a number of Urban Splash development and regeneration projects.<\/span><\/p>\n
