{"id":2027038,"date":"2019-03-05T07:43:41","date_gmt":"2019-03-05T07:43:41","guid":{"rendered":"http:\/\/www.thebusinessdesk.com\/westmidlands\/?p=2027038"},"modified":"2019-03-05T08:18:47","modified_gmt":"2019-03-05T08:18:47","slug":"no-corporate-manslaughter-charges-after-drayton-manor-death","status":"publish","type":"post","link":"https:\/\/www.thebusinessdesk.com\/westmidlands\/news\/2027038-no-corporate-manslaughter-charges-after-drayton-manor-death","title":{"rendered":"No corporate manslaughter charges after Drayton Manor death"},"content":{"rendered":"<p>The Health and Safety Executive (HSE) will now take over the investigation into the death of an 11-year-old girl at Drayton Manor theme park after the Crown Prosecution Service and Staffordshire Police decided the threshold for gross negligence or corporate manslaughter had not been met.<\/p>\n<div id=\"attachment_2002809\" style=\"width: 310px\" class=\"wp-caption alignright\"><img decoding=\"async\" aria-describedby=\"caption-attachment-2002809\" class=\"size-medium wp-image-2002809\" src=\"http:\/\/www.thebusinessdesk.com\/_files\/images\/may_17\/Splash-Canyon-300x232.jpg\" alt=\"\" width=\"300\" height=\"232\" srcset=\"https:\/\/www.thebusinessdesk.com\/_files\/images\/may_17\/Splash-Canyon-300x232.jpg 300w, https:\/\/www.thebusinessdesk.com\/_files\/images\/may_17\/Splash-Canyon-200x155.jpg 200w, https:\/\/www.thebusinessdesk.com\/_files\/images\/may_17\/Splash-Canyon.jpg 339w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-2002809\" class=\"wp-caption-text\">The Splash Canyon ride at Drayton Manor<\/p><\/div>\n<p>Evha Jannath died after falling from the park\u2019s Splash Canyon water ride in May 2017.<\/p>\n<p>A forensic pathologist concluded Evha died as a result of drowning. A file has been prepared for the coroner and an inquest will take place later this year.<\/p>\n<p>Det Insp John Quilty from Staffordshire Police said: \u201cThe investigation into the tragic death of Evha has been extremely complex and we have worked closely throughout with the park, HSE and CPS.<\/p>\n<p>\u201cEvha\u2019s family have been made aware of the findings and our thoughts remain with her family and friends.\u201d<\/p>\n<p>Staffordshire Police&#8217;s file has now been passed to the HSE, which will consider if any other offences are applicable.<\/p>\n<p>A HSE spokesperson said: \u201cHSE has supported Staffordshire Police since this incident took place and has supported the inquiry throughout.<\/p>\n<p>\u201cThis remains a criminal investigation and we will be considering whether there were any breaches of health and safety law relevant to the circumstances of this tragic event.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>HSE to continue criminal
