A construction company has been fined after repeated breaches of workplace welfare regulations across four sites in the region.<\/p>\n
An inspection by the Health and Safety Executive (HSE) at Ling Developments’ site at The Crest, Telford, in April 2024 found failures, including a lack of hot or warm running water in toilet facilities and insufficient rest areas for workers.<\/p>\n
Following the visit, two improvement notices were issued requiring the company to bring standards up to legal requirements.<\/p>\n
The HSE said the issues formed part of a wider pattern, with the company previously found to have breached the same regulations on three separate occasions.<\/p>\n
An investigation concluded that, despite earlier enforcement action and guidance, welfare standards had continued to fall below the required level across multiple sites.<\/p>\n
Under the Construction (Design and Management) Regulations 2015, principal contractors are required to provide adequate welfare facilities, including access to clean hot and cold or warm water, suitable rest areas with seating and tables, and appropriate spaces for workers to prepare and consume meals.<\/p>\n
Ling Developments, based in Wombourne, Wolverhampton, pleaded guilty to breaches of the regulations and was fined \u00a315,858 at Birmingham Magistrates\u2019 Court. The company was also ordered to pay \u00a33,858 in costs.<\/p>\n
HSE Inspector Natalie Spurrier said: \u201cThe provision of suitable welfare facilities such as hot running water and basic rest facilities are the minimum all workers should expect \u2013 they aren\u2019t a luxury.<\/p>\n
\u201cOur investigation found that Ling Developments Limited failed in its duty to provide the minimum standard of welfare facilities at some of its construction sites. Failing to comply with legal obligations such as in cases like this, places workers at unnecessary risk.<\/p>\n
