A financial adviser has been banned from working in UK financial services and fined \u00a3755,000 after the Financial Conduct Authority (FCA) found he acted without integrity and put customers at risk through unsuitable pension transfer advice.<\/p>\n
Frank Breuer, the former joint owner and sole director of Birmingham-based Bluesky Wealth Management, was sanctioned following an FCA investigation into the firm\u2019s handling of defined benefit (DB) pension transfers.<\/p>\n
Bluesky was authorised to advise clients on DB pension transfers, but the FCA said the business failed to maintain the required professional indemnity insurance from April 2019 onwards – leaving customers exposed if advice later proved unsuitable.<\/p>\n
Despite knowing the firm was uninsured, Breuer carried out at least 16 DB pension transfers, according to the regulator. The FCA also said he repeatedly misled the watchdog about the company\u2019s insurance position.<\/p>\n
The regulator found that Breuer later breached restrictions imposed on the business in October 2019, which had been introduced to safeguard customer interests and preserve company assets.<\/p>\n
Instead, the FCA said he extracted funds from the company through large dividend payments, personal loans and transfers through connected accounts while concerns over Bluesky\u2019s pension advice mounted.<\/p>\n
By September 2020, the regulator had begun scrutinising the suitability of the firm\u2019s DB transfer recommendations. From June 2022 onwards, the Financial Ombudsman Service upheld multiple complaints relating to advice provided by Bluesky.<\/p>\n
The company ultimately entered insolvency proceedings in April 2023, leaving customer liabilities of at least \u00a3214,772.88 to be covered by the Financial Services Compensation Scheme (FSCS).<\/p>\n
Therese Chambers, joint executive director of enforcement and market oversight at the FCA said:
\n\u201cMr Breuer sought to evade paying compensation due to customers as a result of his own bad pension advice and feathered his own nest in the process, stripping substantial assets from his firm. He repeatedly misled the FCA and flouted FCA restrictions. He\u2019s not fit to work in financial services.\u201d<\/p>\n
The FCA said the \u00a3755,000 penalty includes both financial sanctions and disgorgement linked to personal financial benefit gained during the period under investigation.<\/p>\n
Defined benefit pension transfers remain one of the most heavily scrutinised areas of UK financial advice, with FCA rules requiring firms to demonstrate strong justification before recommending that customers give up guaranteed retirement income schemes.<\/p>\n","protected":false},"excerpt":{"rendered":"
