A DEVELOPER has been prosecuted for breaching planning conditions at a development in Flamborough.
East Riding of Yorkshire Council brought proceedings against Leeds developer Christopher Gardener, relating to four dwellings for which he had acted as developer in School Lane, Flamborough, East Yorkshire.
The development was granted planning approval in September 2010 after an appeal to the government’s planning inspectorate. The approval was subject to a number of conditions. Despite warnings, Gardener did not comply with a condition.
The council brought court proceedings against Mr Gardener at Bridlington Magistrates’ Court in November. Gardener was found guilty and fined £2,000 and ordered to pay costs of £2,777.
Des Simmonds, the council’s principal enforcement officer, said: “This clearly shows that the courts take breaches of planning legislation very seriously, especially when every effort has been made by the council to secure compliance with conditions imposed by the planning inspectorate.
“Developers should be aware that the council will continue to pursue any breaches of planning conditions very vigorously, through the courts if necessary.”

HUNDREDS of new jobs have been created at White Rose Shopping Centre this year, with many more to follow.
Among the latest to find employment is a team of six car park assistants and three apprentices employed by OCS, the centre’s facilities management provider.
Gerald Jennings, portfolio director for Land Securities, which owns and manages White Rose, said: “We are delighted that new store and restaurant openings this year have created work opportunities, particularly for young people looking to get a foot on the employment ladder.
“These new jobs are in addition to the 1,000 that will be created should we be successful in gaining planning permission for extension of White Rose, as more job opportunities for local people will come through the introduction of four further restaurants, a multi-screen cinema and extension of the Debenhams and Primark stores.”
