Planning application victory for Lincs development

Law firm Roythornes Solicitors has welcomed the verdict to overturn a planning decision to refuse a new Lincolnshire housing development, which includes affordable housing.

Roythornes, acting on behalf of Ashwood Homes as part of the consultative team, worked on an appeal against the decision to refuse planning permission by South Holland District Council for the residential development of 39 dwellings at Holbeach, Lincolnshire.

Shruti Trivedi, partner and head of planning at Roythornes, said: “We were thrilled to hear that the refused planning application has been granted by the planning inspectorate following a successful appeal proceeding against the decision.

“We lodged the appeal as the development will make a significant contribution to the South East Lincolnshire Council’s five-year housing targets and would also offer affordable housing at a time when it is most needed.”

Members of the Council’s planning committee refused the planning application on the basis of whether the development would result in unacceptable living conditions for future residents with regard to outlook and natural light. The planning inspectorate ruled that sufficient measures had been taken with acoustic fencing and adequate design of the scheme to ensure that this would not be the case.

“In the South East Lincolnshire housing paper from January 2017 the council identified Holbeach as one of the ‘most sustainable locations for development’ and ‘suitable as a location for a higher housing target’ so it’s great that we are able to contribute to this area and the council’s targets.

“The Holbeach development will provide for 39 new houses comprising 1, 2 and 3 bedrooms to be constructed to their usual exceptional build quality and high specification, together with associated parking and communal amenity space. Furthermore, the development will provide 6 new affordable homes which will be available to eligible households whose needs are not currently met by the market”.
