A Birmingham healthcare company has become the first in the country to be prosecuted for knowingly or recklessly providing false or misleading information to The Pensions Regulator.

Crest Healthcare and its managing director Sheila Aluko are accused of falsely claiming they had enrolled 25 staff into a workplace pension scheme.

They are also accused of failing to comply with their automatic enrolment duties under section 45 of the Pensions Act 2008.

It is an offence to knowingly provide false information to The Pensions Regulator, which regulates work-based pension schemes.

They have been summonsed to appear at Brighton Magistrates’ Court next week. If found guilty, the maximum penalties are two years’ imprisonment or an unlimited fine.
