Wholesaler takes legal action against former directors

A Nottingham-based wholesaler has launched legal proceedings against its former managing director and commercial director, according to a report by Better Retailing.
Hyperama alleges that the two former employees downloaded confidential company information which was then passed on to Bestway, the UK’s largest independent cash and carry business, where the latter had moved after leaving the the firm.
Hyperama claims the information was used to create a business plan for Bestway which would enable the London-based firm to target parts of its customer base.
Better Retailing also quotes Hyperama as stating that the pair “acted fraudulently in the course of their employments by dishonestly diverting secret profits.”
According to the report, the Nottingham firm’s erstwhile managing director helped to establish a new wholesale business through which the pair bought produce from Hyperama’s suppliers, “before selling it on to Hyperama at an inflated price.”
The case is ongoing and both individuals “strenuously” deny the allegations.
